General Terms
User agrees to take full responsibility for the content of the submission and user further agrees to abide by the terms and conditions of usage defined. All entries and content are subject to moderation. Content that is defamatory, malicious, and offensive or involves breach of copyright, trademarks or other intellectual property rights will not be allowed.
Users are responsible for any communication submitted through the website, including without limitation its truthfulness and accuracy.
Users are solely responsible for compliance with all applicable laws and regulations regarding users use of the website including without limitation all applicable regulations.
User agrees not use any device, software or routine to interfere with the proper working of the website or which is intended to damage, interfere with or surreptitiously intercept or expropriate any system, data or personal information. User agrees not take any actions which may undermine the integrity of the website.
Users application by electronic means is submitted at Users own responsibility and risk. In particular NTPL shall not be liable for loss of data and illegal intrusion into the respective systems by third parties.
Users are responsible for ensuring they are able to accept the invitation provided on the website. Further Users agree to the additional terms and conditions attached to registration and such invitation or scheme would apply in addition to these Terms and Conditions. In the event that any of the terms and conditions, contained herein conflict with the additional conditions contained within any particular scheme or invitation, then the additional conditions shall prevail.
NTPL reserves the right to change the terms, conditions, and notices under which this website has offered, and we may seek fees and charges for access and use thereof. Therefore, user agrees to regularly review these terms and conditions to know and understand the prevailing terms and conditions.
Intellectual Property Rights
Users must own the intellectual property (IP) rights; including the copyright in or have permission to use any materials submitted at the NTPL's. website and will be ready to transfer its IP to BEL. NTPL will not be responsible for breach of any copyright or other third-party intellectual property and proprietary rights by the user.
By applying each user hereby warrants that they are the original author of the submission and that the submission does not or will not infringe any third party's intellectual property and proprietary rights, including their copyright, patent, trade mark, trade secret, design, or other proprietary rights or rights of publicity or privacy.
Non- Confidential Information
Users agrees to the fact that users submitted information are considered non-confidential and non-proprietary and NTPL does not want to receive any confidential or proprietary information or materials through the website. User also agrees that by submitting their information to NTPL for review, User understands that NTPL will not treat the submitted information confidential or proprietary and thus NTPL will not be restricted from using the Idea. NTPL will need to disseminate the submitted information to different parts of the organisation to evaluate whether we can work together to develop the proposal.
User agrees that their submitted information to NTPL through the website will be received by BEL on a non-confidential basis. User also agrees that NTPL will have the right to use the submitted information and materials comprised therein free of charge as NTPL sees fit and to share it within NTPL and with concerned third parties.
Data Protection
User agrees that NTPL may process Users personal data for the purpose of assessing users submission and contacting the user. The collection and storage of personal information for the purposes of the website will be conducted in accordance with all applicable data protection laws of India and the EU Directive for Data Protection.
Guaranty
Users agrees that NTPL has all necessary rights to disclose and submitted information can be shared to Customer for the purposes of the Contest. User agrees that the disclosure and submitted information does not breach any contract or obligation between User and any third party. User agrees that the submitted information do not contain any viruses, Trojan horses, worms, harmful code or any other element that is malicious or damaged
Warranty & Indemnification
Users agrees to indemnify NTPL officers, directors, employees, agents, licensors and suppliers, other users of NTPL's website against any and all expenses, losses, damages and costs, which may be resulting from any violation of all terms and conditions or any activity related to the Users account or any third party claim/action/proceedings including but not limited to those relating to breach of intellectual property rights or confidentiality, by User or any other person accessing the website using the account of the user.
In no event shall NTPL be liable for any direct, indirect, special, punitive, incidental, exemplary or consequential, damages, or any damages whatsoever, even if they have been previously advised of the possibility of such damages, whether in an action under contract, negligence, or any other theory, arising out of or in connection with the use, inability to use, or performance of the information, services, products, and materials available from this site. These limitations shall apply notwithstanding any failure of essential purpose of any limited remedy.
Limited Liability
User agrees that NTPL shall not be responsible for any indirect or consequential loss or similar damage, including without limitation loss of profit, loss of revenue or loss of contracts. The limitations of liability under this section do not apply to any damage caused by the liable Users wilful misconduct, gross negligence, breach of confidentiality obligations or infringement Intellectual Property Rights.
Governing Law and Arbitration
User agrees that this agreement shall be governed by and construed in accordance with the laws of the India. Any dispute, controversy or claim arising out of or relating to this Agreement, or the breach, termination or validity thereof shall primarily be settled through negotiation between the parties. In case the dispute cannot be resolved amicably, the dispute shall be finally settled by arbitration in accordance with the Arbitration Rules.
